1. About These Terms
These Terms and Conditions govern the provision of building, renovation, and construction services by ASP Build & Co (ABN to be confirmed), holder of South Australian Builder’s Licence BLD 342431, trading as ASP Build & Co (“we”, “us”, “our”).
By engaging ASP Build & Co to perform any services, or by accepting a written quote or proposal from us, you (“the Client”) agree to be bound by these terms. Please read them carefully before proceeding.
2. Quotes & Proposals
All quotes provided by ASP Build & Co are valid for 30 days from the date of issue unless otherwise stated in writing. Quotes are based on the scope of work described at the time of quotation.
Any variations to the agreed scope of work — including additions, deletions, or modifications requested by the Client — will be subject to a formal variation order and may affect the final price and timeline.
ASP Build & Co reserves the right to withdraw or revise any quote prior to formal written acceptance by the Client.
3. Payment Terms
Payment terms will be outlined in the written contract or proposal for each project. Standard payment schedules are structured around project milestones. All invoices are due within 7 days of the invoice date unless otherwise agreed in writing.
Late payments may attract interest at the rate of 2% per month on the outstanding balance. ASP Build & Co reserves the right to suspend work on any project where payment obligations are not met.
A deposit is required before any work commences. The deposit amount will be specified in the project contract and is non-refundable if the Client cancels the project after work has commenced or materials have been ordered.
4. Scope of Work
The scope of work for each project will be defined in a written contract or statement of works agreed to by both parties prior to commencement. ASP Build & Co will perform all work in accordance with the agreed scope, applicable Australian Standards, and the National Construction Code.
Any work identified during the project that falls outside the agreed scope — including unforeseen conditions such as asbestos, structural issues, or concealed plumbing faults — will be communicated to the Client promptly and addressed via a formal variation order.
5. Licences & Compliance
ASP Build & Co holds South Australian Builder’s Licence BLD 342431 issued by Consumer and Business Services SA. All work performed by ASP Build & Co complies with applicable South Australian legislation, including the Building Work Contractors Act 1995 and all relevant building codes and standards.
Where required, ASP Build & Co will obtain relevant building consents and development approvals on behalf of the Client. Any council or government fees associated with approvals are not included in quotes unless expressly stated.
6. Warranties & Defects
ASP Build & Co provides a statutory defects liability period as required under South Australian law. During this period, we will rectify any defective work at no cost to the Client, provided the defect arises from our workmanship or materials and not from Client-directed changes, misuse, or third-party interference.
Manufacturer warranties on materials and fixtures are passed through to the Client where applicable.
7. Client Responsibilities
The Client agrees to provide safe and unobstructed access to the work site during agreed working hours. The Client is responsible for removing or securing any personal belongings, valuables, or items that may be affected by building works.
The Client must promptly review and respond to variation requests, design decisions, and material selections to avoid delays to the project timeline.
8. Liability
To the maximum extent permitted by law, ASP Build & Co’s liability for any claim arising from our services is limited to the total value of the relevant project contract.
ASP Build & Co is not liable for indirect or consequential losses, including loss of income, loss of use, or costs arising from project delays caused by circumstances outside our control (including weather, material supply delays, or subcontractor availability).
ASP Build & Co maintains appropriate public liability insurance and home indemnity insurance as required by South Australian law.
9. Disputes
In the event of a dispute, both parties agree to attempt to resolve the matter in good faith through direct negotiation before escalating to formal dispute resolution. If a dispute cannot be resolved informally, it may be referred to the relevant South Australian dispute resolution authority.
10. Intellectual Property
All designs, drawings, plans, and documentation prepared by ASP Build & Co remain our intellectual property until full payment is received, at which point relevant project documents are provided to the Client.

12. Governing Law
These Terms and Conditions are governed by the laws of South Australia, Australia. Any disputes arising from these terms are subject to the exclusive jurisdiction of the courts of South Australia.
